Non-Delivery & Refund Disputes

An advance is paid, delivery keeps slipping or an agreed refund never arrives. Establish the agreement and performance status before assessing delivery, refund or other requests.

01

Establish what has been performed

Identify the original and revised dates, work completed, goods delivered and any new arrangement accepted. Retain each extension and refund promise rather than relying only on the last message.

02

Payment and refund terms

Review the agreed nature of the payment and cancellation, breach and refund terms. The English word deposit does not by itself establish a particular Chinese-law payment category or an entitlement to double repayment.

03

Make the refund record specific

Identify who promised the refund, the company represented, amount, currency, payment date and conditions. Review instalments, future-order credits or partial refunds against the original position before accepting.

04

Assess the next step and cost

After reviewing documents and parties, discuss further communication, a letter, settlement or procedural assessment. Continuing operations, asset information and costs relative to the amount matter.

Scope and limitations

This page does not determine a right to terminate, obtain a refund or receive a particular multiple of compensation. The contract, applicable rules and facts require review.

Start with a short summary

Describe your role, the other party, events, current stage and objective. Add amounts and currency for transactions. A brief summary is enough to start.
