Medical injury & medical aesthetics disputes

For patients and families, organise the treatment history, records and communications to assess medical injury or medical aesthetics disputes. This is a separate enquiry route from healthcare business contracts and governance.

01

Start with treatment history and present needs

Describe treatment dates, procedures, the concern, follow-up care and prior discussions. Distinguish injury, billing issues and dissatisfaction with an outcome. Current treatment needs belong with medical professionals.

02

Organise records and consent documents

List available records, tests, procedure notes, consent forms and bills. Note requests for copies or sealing and responses. Preserve originals; online descriptions alone do not establish a clinical error.

03

Separate medical assessment and legal work

Discuss record indexing, communication requests, negotiation or mediation preparation, and assessment of expert review or litigation. The need, organiser, cost and questions for expert assessment depend on the records; legal work does not replace medical expertise.

04

Frame questions that can be checked

Agree a treatment timeline, missing-record list, questions for the institution or experts and next-stage scope. For medical aesthetics, also identify the procedure, provider, representations and signed documents.

Hong Kong, Macao or other cross-border factors

For a Hong Kong or Macao resident treated in mainland China, or treatment across locations, identify each provider, treatment location and record source. Responsibility of providers elsewhere and local procedures require separate assessment.

Two questions to clarify

Is this the same service as healthcare business advice?

No. This page concerns patients’ and families’ treatment disputes. Commercial contracts, governance and company matters belong to the healthcare business service.

Does a disappointing outcome mean compensation is payable?

An outcome alone is insufficient. Review treatment records, the alleged injury, expert assessment and legal relationships; aesthetics matters also require the agreement and actual service.

Scope and limitations

An outcome or dissatisfaction alone does not establish fault, causation or compensation. Agree an appropriate channel before providing health records.

Start with a short summary

Describe your role, the other party, events, current stage and objective. Add amounts and currency for transactions. A brief summary is enough to start.
