Child maintenance: claims, changes & enforcement
Identify whether maintenance is undecided, agreed, ordered, subject to a change request or at enforcement stage. Organise the child’s needs, payments, arrears and existing documents.
Identify existing documents and the stage
Identify any divorce agreement, settlement, judgment or other arrangement, payment terms and prior steps. An initial claim, variation and enforcement need different material.
Reconcile payments and reasonable expenses
List amounts due, paid and unpaid by period, with payment records. Separate changes in education or medical expenses from general household and one-off spending.
Assess variation and enforcement separately
Where needs or payment circumstances change, review existing documents and facts. For an unfulfilled order, explain procedural status and lawfully held information before assessing enforcement work. No fixed proportion or increase is promised.
Build a stage-specific action list
Agree a payment ledger, changed-expense index, evidence gaps and next route. Define negotiation, claim, variation and enforcement work separately, and distinguish contact disputes from payment issues.
Hong Kong, Macao or other cross-border factors
If a payer or child is in Hong Kong/Macao, or an order was made elsewhere, identify locations, document origin and performance. Cross-border recognition or enforcement needs an assessment of the document and procedure.
Two questions to clarify
Is an unpaid agreement handled like an unpaid judgment?
Check the document’s legal nature, terms and procedural stage before selecting a claim or enforcement route. Its title alone does not establish direct enforceability.
Can changed expenses justify a maintenance review?
Organise existing arrangements, changed needs and supporting expenses for assessment. Whether and how maintenance changes depends on facts and applicable requirements, with no preset increase.
Scope and limitations
A single income percentage is not used to quote or predict an award. Do not include a child’s ID number, full school address or unnecessary identifying details in the first enquiry.
